2. User Accounts and Memberships
To use our services, you must create a user account. You are responsible for safeguarding your account details, including your password, and for all activities that occur under your account.
Membership Subscriptions: By signing up for one of our packages, you become a member and agree to a recurring subscription fee. Membership provides unlimited ad listings for the duration of your subscription period. Subscription plans are available on a monthly (30 days), 3-monthly (90 days), or annual (365 days) basis.
3. Privacy and Information Collection
We are committed to protecting your privacy. We collect and use your personal information in accordance with the Privacy Act 2020. By using our website, you agree to the collection, use, and disclosure of your personal information as described here. We will collect information from you when you register, subscribe, post ads, or use other services. We will use this information for the purpose it was collected, including managing your account, providing services, and communicating with you. We will not use or disclose your personal information for any other purpose without your consent, except where required by law.
What we collect
Account details, identity and contact info, listing and communications, device data, payments via paypal and bank direct transters for our paid services, and verification/fraud signals.
Why we collect (lawful purposes)
To run the marketplace, prevent fraud and to abuse, fufil legal/tax obligations, support users, improve services, and to communicate with you.
Messaging and commercial emails (anti-spam)
- Using the messaging service on posted ads throughout our website give opportunity for buyers and sellers to provide answers to questions about the products or services listed. Please refrain from idle chit chat when using post messaging.
- If at anytime you wish opt out of being included in our regular updates via email; please email us at admin@nzbuysellexhange.co.nz and write UNSUBSCRIBE ME! Upon receiving your email administration will ensure you will no longer be sent future email updates.
Security, retention and breach notification
- We use resonable safeguards; we retain data only as long as needed for our porposes and legal requirements. If a provacy breach is lilely to cause serous harm, we will notify affected individuals and the Office of the Privacy Commissioner as soon as praticable.
Cookies & Analytics
- We use cookies/analytics to operate, secure and improve the site; you can control cookies via browser settings (functionality may be affected.) We use services like google analytics to measure traffic and search statistical information for marketing purposes.
4. User Conduct and Content
You agree to use the website for lawful purposes only.
All information you provide and content you post, including listings and communications, must be accurate, complete, and truthful. You must not mislead or deceive other users and must not use unfair practices (including bait pricing or hidden fees). We may remove content or suspend accounts that breach these rules.
You are solely responsible for all content you upload or transmit through the website.
You must not post content that infringes on the intellectual property rights of others. By submitting content, you grant nzbuysellexchange.co.nz a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content on the website.
- We prohibit bullying, doxxing, and non-consensual intimate images or messages or content in ads. Use Report on any listing, message or profile – serious cases may be referred to authorities for quick removal and remedies.
5. Buying, Selling, and Exchanging
Role as a Platform: nzbuysellexchange.co.nz acts solely as a venue for users to interact and facilitate transactions. We are not a party to any transaction between a buyer, seller, or exchanger. We do not own the items listed, nor do we act as an agent, broker, or partner in any transaction.
Disclaimer of Liability: We are not responsible for the quality, safety, or legality of the items listed, the accuracy of listings, or the ability of users to complete a transaction. All transactions are at the sole risk of the participants.
Applicable Legislation: All users who are “in trade” (selling goods as a business) must comply with the Fair Trading Act 1986. The Consumer Guarantees Act 1993 applies to goods and services supplied by a business “in trade,” but it does not apply to private sales between individuals. Sellers “in trade” on this platform are solely responsible for meeting their obligations under this Act. Business (“in-trade”) sellers must enable the Company setting.
Taxes & Gst (platform = sellers)
- We’ll clearly indicate who collects GST on each order for our paying subscribers who purchase a package. The marketplace must collect and return 15% Gst. For low- value imported goods shipped to NZby overseas sellers, Gst obligations may also apply under NZ rules. Tax invoices will idendity the correct issuer.
- All Sellers who are in trade using the Company type are responsible for their own Gst when selling goods or services.
- Consumer rights (CGA applies to traders)
- Where the seller is in trade as a company, NZ consumer law provides remedies for goods/services that are not acceptable quality or fit for purpose (repair, replace, refund). Private sales are not covered by the CGA.
6. Advertising
Banner Advertising: Business members who wish to place banner advertisements on the website must contact us directly via email to discuss their specific needs. The cost for banner advertising is NZD$1,000 per month (30 days). Business members will provide us with their information, images, and any digital content for the purpose of placing their banner ad on our website for promotional purposes, with a link that leads back directly to their business. By using our website, all users agree that the information and content on their banners are not misleading, are truthful, correct, do not infringe on anyone elses copyright and are safe for our visitors who might click on them.
7. Intellectual Property
The content, design, logos, and trademarks on this website, including your two logo designs, are the property of nzbuysellexchange.co.nz or its content suppliers and are protected by New Zealand copyright and intellectual property laws.
No part of this site may be copied, reproduced, or used without express written permission.
8. Liability and Indemnity
To the maximum extent permitted by New Zealand law, nzbuysellexchange.co.nz will not be liable for any loss or damage arising from your use of the website or from any transactions conducted through it.
You agree to indemnify and hold us harmless from any and all claims, damages, or losses arising from your use of the website or your breach of these terms.
9. General
These terms are governed by the laws of New Zealand. Any disputes will be resolved in a New Zealand court.
- We provide the platform, tools, and payment rails; the contract of sale is between the buyer and seller. We may request evidence, or make a final decision on ourcomes consistent with NZ law. Buyers can also seek help from the Commerce Commission (FTA Issues) or the Disputes Tribunal (eligible claims).
We reserve the right to amend these terms at any time. We will notify you of any changes by posting the updated terms on the website. Your continued use of the website constitutes your acceptance of the changes.

- You can access and correct your information, manage marketing preferences to opt in or opt out via email, and request deletion where applicable.

International use, sanctions & restricted locations
You may use nzbuysellexchange.co.nz from overseas only if doing so complies with all applicable laws (New Zealand and your own). You must not use our services if you are:
Located in, ordinarily resident in, or acting for a person/entity in a country, region, vessel, or sector subject to New Zealand or UN sanctions, or
Listed on any UN Security Council or New Zealand sanctions/designations list.
Current examples (for clarity, not exhaustive): New Zealand implements UN sanctions and maintains a separate Russia sanctions regime (including some Belarus and shipping “shadow fleet” actors). New Zealand also re-imposed sanctions on Iran effective 18 Oct 2025. We align with updates published by MFAT and related government notices.
We maintain a live Prohibited & Restricted Jurisdictions page and may geo-block, payment-block, or KYC-screen users and orders to meet legal obligations. Access may be suspended without notice to comply with sanctions or export controls.
Your compliance
International buyers and sellers agree to:
Comply with New Zealand law when using our services (including UN/NZ sanctions and export/import controls).
Comply with your local laws (consumer, tax, customs, product safety, and any licensing/registration rules).
Not route transactions through third parties to circumvent sanctions or marketplace rules.
Taxes, duties & invoices
- You’re responsible for your own taxes and duties in your country. We’ll display who collects NZ GST on an order (marketplace or seller) according to New Zealand rules; this does not relieve you of any non-NZ taxes.
Screening & evidence
- We may request identity, business, or shipment evidence (including end-user and destination information) and decline or cancel any listing, payment, or shipment that presents sanctions or compliance risk.
Privacy Statement — international disclosure note (add under “Overseas transfers”)
- We may process or disclose personal information to service providers and partners outside New Zealand. Before doing so, we take reasonable steps to ensure comparable safeguards or rely on another permitted ground under IPP12 of the Privacy Act 2020 (e.g., approved contractual clauses or your express informed consent). This includes screening data to comply with UN/NZ sanctions and export-control obligations.
